1. This Promotion is open to all residents in the UK and Republic of Ireland aged 16 years and over, excluding employees and the families of employees of the Promoter or their affiliates, agencies or anyone professionally connected with this Promotion.
2. This Promotion commences on 01/04/2008 at midnight, and song codes will be valid from this date. This Promotion ends and codes expire on 01/12/2008 at midnight.
3. A purchase is required for this Promotion. This Promotion is available with promotional packs of Duracell AA or AAA batteries in 4, 6, 8 and 12 size packs or Duracell Active Charge and PowerPix AA or AAA batteries in 4 size packs, while stocks last.
4. To claim your free song:
4.1 Go to www.duracell.com/music;
4.2 Click on “Click here to choose your song”; and
4.3 Select any song from the catalogue. The speed at which your song downloads will depend on
your internet connection;
4.4 Enter your personal data; and
4.5 Enter the 8 character song code found on the inside of promotional packs.
5. Each valid song code can only be entered once to redeem one song.
6. All song codes are subject to validation. The Promoter reserves the right to disqualify from this Promotion any participant suspected of fraud or dishonesty, including without limitation, through the manipulation of song codes or otherwise fraudulently falsifying data or acting fraudulently or dishonestly in the opinion of the Promoter. If a song code cannot be read due to a genuine printing error, please return the entire pack to the Promoter at Duracell Skywalker Music 2008, Dept PA088, PO Box 10, Diss, Norfolk, IP98 1SP, UKXXXX together with your name, date of birth, complete address and daytime telephone number on a plain piece of paper during the term of the Promotion. The Promoter will not be responsible for packs lost in the post and proof of posting does not constitute receipt.
7. You will need a valid email address and you will be required to provide personal information to the Promoter to participate in this Promotion. All personal data collected during participation in this Promotion will be held in accordance with the Data Protection Policy set out on www.duracell.com/. Participants in this Promotion will be given the option to ‘opt-in’ to receive further communications from the Promoter. By opting in, the participant gives permission for the Promoter to communicate with them and if at any time participants do not wish to receive further communications from the Promoter they can use the ‘unsubscribe’ option is provided in all communications.
8. The song code expires on 01/12/2008 at midnight and is redeemable only on the www.duracell.com/music website for the XXXX. After the closing date of 01/12/2008 all unredeemed codes will be invalid and cannot be redeemed in any other promotion.
9. The gift of a free song is as stated and cannot be transferred, sold or exchanged. No cash alternative, in whole or part, is available.
10. To the extent permitted by law, the Promoter will not be responsible or liable for:
10.1 any defect or quality issue with the Universal International Music B.V. software or any
song;
10.2 inability to participate in the Promotion due to system failure, network error, site being
down, hacks on the system, personal computer issues, inability to access or unavailability of the internet or the website at www.duracell.com/music or any combination thereof;
10.3 incorrect entry of the song code or for any failed electronic data transmission;
10.4 theft, destruction, or alteration of or unauthorised access to a song code during this
Promotion;
10.5 communications failure for any reason with regard to any equipment, systems, lines,
networks, satellites, computers, servers or providers used in relation to this Promotion;
10.6 any damage to a participant’s or any other person’s computer related to or resulting
from an attempt to participate in this Promotion, including without limitation, the download of any song as part of this Promotion;
10.7 the content of any song if, for any reason the promotion or the www.duracell.com/music
website is not capable of operating for any reason, including without limitation, computer virus, hacking, unauthorised intervention, fraud, technical failures or any other cause which may corrupt or affect the security, administration, integrity or proper conduct of this Promotion; and
10.8 failure by any third party to fulfill their obligations in relation to this Promotion.
11. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide the
stated gift, the Promoter reserves the right to provide a substitute gift of equal or greater value at the Promoter’s discretion.
12. All instructions relating to this Promotion form part of these Terms and Conditions. By
participation in this Promotion, participants agree to be bound by these Terms and Conditions. Any breach of these Terms and Conditions will, without limitation, result in forfeiture of the gift. The Promoter reserves the right to amend these Terms and Conditions from time to time where reasonably required by notice on www.duracell.com/music. The Promoter reserves the right at its sole discretion to cancel, terminate, modify or suspend this Promotion on whole or in part.
13. If any provision of these rules is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. The law of Switzerland shall be exclusively applicable to any and all disputes arising out of or in connection this Promotion. Any such dispute shall be non-exclusively submitted to the competent court in Switzerland.
14. The Promoter’s decision is final and no correspondence will be entered into.
